This Privacy Policy describes how Bid, Buy & Drive, LLC (“BB&D,” “we,” “us,” or “our”) collects, uses, and shares information about you when you use our website at www.bidbuyanddrive.com (the “Site”) and the related services we provide (collectively, the “Service”). By using the Service, you agree to the collection and use of information in accordance with this Privacy Policy. This Privacy Policy is incorporated into our User Agreement Terms of Service.

1. Information We Collect

A. Information You Provide Directly

We collect information that you provide when you create an account, list a vehicle, place a bid, post a comment, contact us, or otherwise interact with the Service. This may include:

Account information: name, email address, phone number, mailing address, username, password, date of birth (to verify you are at least 18), and profile photograph if uploaded.
Listing and seller information: vehicle details, photographs, descriptions, condition disclosures, title information, reserve price, and any other content you submit as a Seller.
Bidding and transaction information: bids placed, auctions won, payment confirmations, and communications with other Users related to a transaction.
Comments and community content: any text, images, or other content you post in community discussion features.
Communications with us: the content of emails, support tickets, dispute submissions, and any other correspondence you send to BB&D.
Payment information: when you pay a Buyer’s Premium, listing fee, deposit, or other amount due to BB&D, payment is processed by our payment processor (currently GoDaddy Payments). BB&D does not store your full credit or debit card number; we receive a confirmation, transaction reference, and limited card identifiers (such as the last four digits and expiration) from the processor.

B. Information Collected Automatically

When you use the Service, we and our service providers automatically collect certain information, including:

Device and connection data: IP address, browser type and version, operating system, device identifiers, and general location inferred from IP address.
Usage data: pages viewed, listings browsed, links clicked, search queries, time spent on pages, referring and exit pages, timestamps, and similar interaction data.
Cookies, pixels, and similar technologies: see Section 5 below for details.
Security and abuse-detection data: information about requests to the Service that may indicate spam, fraud, scraping, or other abuse, collected by our security provider (currently Sucuri).

C. Information from Third Parties

We may receive information about you from:

Payment processors (currently GoDaddy Payments) confirming payment status, decline reasons, and chargeback notifications.
Authentication or verification services if we use them to verify identity, address, or eligibility.
Other Users who refer you to the Service or who interact with you in connection with a transaction or community discussion.
Public sources such as vehicle history databases, court records, or DMV filings, when relevant to dispute resolution or fraud prevention.

2. How We Use Information

We use the information we collect to:

create and maintain your account, authenticate your access, and communicate with you about the Service;
operate auctions, process bids, calculate Buyer’s Premium and fees, and facilitate the introduction of Buyers and Sellers after auction close;
process payments due to BB&D and resolve payment disputes;
enforce our Terms of Service, investigate suspected violations (including off-platform transaction circumvention), moderate comments, and protect the security of the Service and its Users;
send transactional messages (account confirmations, bid notifications, password resets, auction outcomes, dispute correspondence);
send marketing messages such as newsletters, promotional offers, and announcements about new features or auctions, where you have not opted out;
analyze how Users interact with the Service to improve features, performance, and User experience;
comply with applicable laws, respond to subpoenas or other legal process, and exercise or defend legal rights.

3. How We Share Information

We do not sell your personal information for monetary consideration. We share information in the following limited circumstances.

A. Service Providers

We use third-party service providers to operate the Service. They process information on our behalf under contractual obligations to safeguard it. Our key providers include:

GoDaddy (Managed WordPress hosting and the underlying website infrastructure).
GoDaddy Payments (payment processing for amounts due to BB&D).
Sucuri (web application firewall, content delivery, and security monitoring).
Brevo (formerly Sendinblue) (transactional email such as bid notifications and account confirmations, and marketing email such as newsletters where applicable).
Microsoft 365 (business email correspondence to and from BB&D staff at addresses such as sales@bidbuyanddrive.com).
js (bundled with WooCommerce; provides order attribution and marketing analytics that help us understand how visitors arrive at our site and complete transactions). See Section 5 for more detail.
Google Analytics 4 (provided by Google LLC; measures aggregate site usage such as pageviews, session duration, referral sources, and general geographic region inferred from IP address, so we can improve the Service). Analytics tags load only after you consent to analytics cookies through our cookie banner. See Section 5 for more detail.
YITH (auction functionality plugin operating within our website).

We may add, replace, or remove service providers from time to time and will update this Privacy Policy accordingly.

B. Other Users

When you place a winning bid, BB&D will share the Seller’s contact information with you, and the Seller will receive your contact information, so that you can arrange payment, title transfer, and transport directly. Your username, profile photograph (if any), bid history visible on listing pages, and comments are also visible to other Users.

C. Legal and Safety Disclosures

We may disclose information when we believe in good faith that disclosure is necessary to: (i) comply with a subpoena, court order, or other legal process; (ii) enforce our Terms of Service or investigate suspected violations; (iii) detect, prevent, or address fraud, security, or technical issues; (iv) protect the rights, property, or safety of BB&D, our Users, or the public; or (v) cooperate with law enforcement.

D. Business Transfers

If BB&D is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, your information may be transferred as part of that transaction. We will notify you (for example, by email or notice on the Site) of any change in ownership or use of your information.

E. With Your Consent

We may share information with other parties at your direction or with your consent.

4. Comments and Public Content

Information you post in public-facing community features (such as listing comments) is visible to other Users and the general public, including search engines. Do not post information you do not want to be public. You are responsible for the content of your comments and other contributions.

5. Cookies and Tracking Technologies

We and our service providers use cookies, pixels, local storage, and similar technologies. We use these for:

Strictly necessary purposes: authentication, session management, security, and shopping/auction functionality. The Service will not function correctly without these.
Analytics: measuring how Users arrive at and interact with the Service so we can improve it and understand marketing performance. We currently use two analytics tools: (i) WooCommerce order attribution tracking (Sourcebuster.js), which collects data such as your IP address, browser and device type, referring URL, and session activity to attribute orders to their marketing source; and (ii) Google Analytics 4 (provided by Google LLC), which sets cookies such as _ga and _ga_<property-id> to distinguish unique visitors and measure site usage (pageviews, session duration, referral sources, and general geographic region inferred from IP address). Analytics data is used in aggregate and is not used to identify you personally. Google Analytics tags load only after you consent to analytics cookies through our cookie banner; you can withdraw consent at any time by reopening cookie preferences from the site footer or by disabling non-essential cookies in your browser settings.
Communications: allowing email service providers to measure whether transactional or marketing emails were opened and which links were clicked.

You can control cookies through your browser settings. Blocking or deleting cookies may affect your ability to use parts of the Service.

6. Your Rights and Choices

A. Account Information

You may review, update, or correct your account information at any time by logging into your account. You may close your account by contacting us at sales@bidbuyanddrive.com. Note that some information may be retained as set out in Section 8 below, even after account closure.

B. Marketing Communications

You can opt out of marketing emails at any time by clicking the “unsubscribe” link in any marketing email or by contacting us at sales@bidbuyanddrive.com. Even if you opt out of marketing, we may still send you transactional and Service-related messages (such as bid confirmations, password resets, and important Terms of Service updates).

C. California Residents (CCPA / CPRA)

If you are a California resident, you have the following rights regarding your personal information, subject to certain exceptions:

Right to know: request information about the categories and specific pieces of personal information we have collected about you, the sources, the purposes, and the categories of third parties with whom we have shared it.
Right to delete: request that we delete personal information we have collected from you.
Right to correct: request correction of inaccurate personal information.
Right to opt out of “sale” or “sharing”: BB&D does not sell personal information for monetary consideration. To the extent any analytics or advertising activity may be considered a “sale” or “sharing” under California law, you may opt out by contacting us at sales@bidbuyanddrive.com.
Right to non-discrimination: we will not deny service, charge different prices, or provide different quality of service because you exercised any of these rights.

To submit a request, contact us at sales@bidbuyanddrive.com. We will verify your identity (typically by confirming control of the email address on your account) before fulfilling the request. You may also designate an authorized agent to make a request on your behalf.

D. EU/EEA, UK, and Other Jurisdictions

If you are located in the European Economic Area, the United Kingdom, or another jurisdiction that grants similar rights, you may have rights to access, correct, delete, restrict, or object to the processing of your personal information, and to data portability. To exercise these rights, contact us at sales@bidbuyanddrive.com. You also have the right to lodge a complaint with your local data protection authority. Our lawful bases for processing include performance of a contract (operating your account and the auctions), legitimate interests (security, fraud prevention, analytics, and direct marketing where permitted), consent (where required), and legal obligation.

7. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect your information, including encryption in transit (HTTPS/TLS), access controls on our systems, monitoring through Sucuri, and contractual safeguards with our service providers. No security measure is perfect. We cannot guarantee that unauthorized third parties will never defeat our safeguards. You are responsible for keeping your password secure and notifying us immediately if you suspect unauthorized access to your account.

8. Data Retention

We retain personal information for as long as needed to provide the Service, comply with legal obligations, resolve disputes, enforce agreements, and operate our business. Specific retention practices include:

Account and transaction records are retained for the life of your account plus a reasonable period thereafter (generally up to seven years) to satisfy tax, accounting, and audit obligations.
Comments and other public community content remain on the Site indefinitely once posted, though you may request anonymization or deletion subject to Section 6.
Server logs, analytics data, and security telemetry are typically retained for a shorter period (generally 12 to 24 months) and then deleted or aggregated.
Information related to a dispute, fraud investigation, or legal matter may be retained for the duration of that matter and any applicable limitations period.

9. Children’s Information

The Service is intended for adults 18 years of age and older. We do not knowingly collect personal information from anyone under 18. If you believe a person under 18 has provided personal information to us, please contact sales@bidbuyanddrive.com and we will delete the information.

10. International Users

The Service is operated from the United States. If you access the Service from outside the United States, your information will be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your jurisdiction. By using the Service, you consent to this transfer.

11. Third-Party Links

The Site may contain links to third-party websites and services. This Privacy Policy applies only to the Service. We are not responsible for the privacy practices of third parties and encourage you to review their privacy policies before providing information to them.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The “Effective Date” at the top of this page indicates when it was last revised. We will notify you of material changes by email and/or by posting a notice on the Site at least thirty (30) days before they take effect. Your continued use of the Service after the effective date of any change indicates your acceptance of the updated Privacy Policy.
